Terms of Service

You must be at least the age of majority in your jurisdiction, or have permission from a parent or legal guardian, to use the Services.

You represent that you have the legal authority to enter into these Terms.

You may need to create an account to access some features.

You agree to:

• provide accurate information
• keep your login credentials secure
• be responsible for activity under your account
• notify us promptly of unauthorized access

We may suspend or terminate accounts that violate these Terms.

PoseDraw provides tools that may include:

• 3D posing and scene composition tools
• AI-assisted image generation or editing tools
• creative workflow tools
• cloud storage or saved projects
• premium subscription features

We may add, remove, or modify features at any time.

You agree not to use the Services to:

• violate any law or regulation
• infringe intellectual property rights
• upload malicious code or attempt unauthorized access
• harass, abuse, threaten, or exploit others
• generate unlawful, defamatory, hateful, or fraudulent content
• interfere with operation of the Services
• scrape, reverse engineer, or misuse the platform beyond permitted use

We may investigate violations and take appropriate action.

You may upload prompts, images, models, text, scenes, and other content ("User Content").

You retain ownership of your User Content, subject to rights necessary for us to operate the Services.

By submitting User Content, you grant PoseDraw a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display the content solely for:

• providing the Services
• maintaining backups
• improving performance and functionality
• complying with legal obligations

You represent that you have all rights necessary to submit your User Content.

The Services may use artificial intelligence systems or third-party providers.

You acknowledge and agree that:

• outputs may be inaccurate, incomplete, or unexpected
• outputs may resemble content created for others
• outputs may not be eligible for copyright protection in some jurisdictions
• you are responsible for reviewing and using outputs appropriately
• PoseDraw does not guarantee originality, fitness, or legal compliance of outputs

Do not rely on outputs for legal, medical, financial, or safety-critical purposes.

PoseDraw does not currently use your User Content to train our own AI models. See our Privacy Policy for details, including how third-party AI providers handle your data.

The Services, including software, branding, interfaces, graphics, and proprietary systems, are owned by PoseDraw or its licensors and protected by law.

Except as expressly allowed, you may not copy, distribute, modify, sell, or create derivative works from the Services.

Some features may require payment.

By purchasing a paid plan, you authorize recurring charges where applicable until cancelled.

Unless otherwise required by law or expressly stated, fees are non-refundable.

You are responsible for taxes, exchange fees, and charges imposed by payment providers.

We may change pricing with reasonable notice.

You may cancel your subscription at any time. Access to paid features may continue until the end of the current billing period unless otherwise stated.

Deleting your account does not automatically cancel subscriptions managed through third-party billing platforms.

The Services are provided on an "as available" and "as is" basis.

We do not guarantee uninterrupted access, error-free operation, or permanent availability of any feature or stored content.

We may suspend, modify, or discontinue any part of the Services at any time.

To the maximum extent permitted by law, PoseDraw and its affiliates, officers, employees, and contractors will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities.

Our total liability for any claim relating to the Services will not exceed the amount you paid to PoseDraw in the twelve (12) months before the event giving rise to the claim.

You agree to indemnify and hold harmless PoseDraw from claims, damages, liabilities, and expenses arising from:

• your use of the Services
• your User Content
• your violation of these Terms
• your violation of any rights of another party

We may suspend or terminate your access immediately if:

• you violate these Terms
• required by law
• your use creates risk or harm
• the Services are discontinued

Sections that should survive termination will remain in effect.

Your use of the Services is also governed by our Privacy Policy.

These Terms are governed by the laws of Ontario and the applicable federal laws of Canada, without regard to conflict of law principles.

Any disputes shall be resolved in the courts located in Ontario, Canada, unless applicable law requires otherwise.

We may update these Terms from time to time.

If changes are material, we may provide notice through the Services or website. Continued use after changes take effect means you accept the revised Terms.

These Terms constitute the entire agreement between you and PoseDraw regarding the Services and supersede prior agreements relating to the Services.
